COVID-19 Restaurant Surcharge

On Wednesday, September 16, New York City Council voted in favor of Int. No. 828, a bill that permits restaurants to charge an additional fee up to 10% of customers’ total bill as an economic recovery support measure during the pandemic. The charge will be separate from gratuity and must be clearly listed on menus and bills.

The law will go into effect after the Mayor, who has been supportive of the bill, signs it. The charge is permitted until 90 days after indoor dining is permitted.
