The Lincoln Square District Management Association, Inc. dba Lincoln Square Business Improvement District and its affiliates and subsidiaries (“LSBID,” “us,” “our” or "we") are committed to protecting your privacy.  We have created this privacy policy ("Privacy Policy") to explain what information we collect about you and what we do with it.  The Privacy Policy applies to all users of the Website. Capitalized terms not defined in this Privacy Policy have the meanings given in our Terms of Use.  This Privacy Policy is part of, and incorporated into, the Terms of Use.

By using or navigating our Website, you acknowledge that you have read, understand and agree to be bound by this Privacy Policy or any modified or substituted policy, as posted, and consent to the collection of your Personal Information (defined below) as described herein.   If you do not agree with these terms, please do not use or visit our Website.


1. WHAT PERSONAL INFORMATION WE COLLECT

We collect both "Personal Information" and "Anonymous Information" about our users.  Personal Information is information that can be used to contact or identify you, such as your full name, email address and phone number, as well as information that is linked to such information. "Anonymous Information" is information that cannot be used to contact or identify you and is not linked to information that can be used to do so.  It includes passively collected information about your activities on the Website, such as usage data, to the extent that information is not linked to your Personal Information.

You can visit and access certain portions of our Website without providing Personal Information.  However, in order to use certain features of our Website, such as subscribing to our electronic newsletter or other electronic mailings, participating in our programs and promotions and participating in sweepstakes or other contests that we may sponsor, you must provide us with Personal Information such as your name, email address, street address and telephone number.  We generally collect this information when you sign up to receive services from us, participate in certain aspects of our Website and take optional online surveys.   We also collect Anonymous Information such as IP addresses, browser types and anonymous demographic information (such as ZIP codes). 

Cookies

We may use cookies, small data files stored on your computer, to customize portions of the Website to your preferences (“Cookies”).  The Cookie by itself does not tell us, or anyone else, who you are or your email address.  If you choose to set your browser to reject all Cookies, please understand that you may have limited access to some of the areas and functionalities of our Website.We may also use third party tracking services, such as Google Analytics, and usage logs, to track and analyze data from users of the Website.

2. HOW WE USE YOUR PERSONAL INFORMATION 

a. Personal Information


 We may use your Personal Information for the following representative purposes:


- Maintain the Website

- Send you communications and administrative emails
- Personalize and tailor the features, performance and support of the Website
- Send you promotional/marketing information, newsletters, offers or other information from us or on behalf of our sponsors or partners
- Provide you with opportunities that we think would be of particular interest to you
- Improve the quality and safety of the Website and perform internal operations such as fraud detection

b. Anonymous Information


We may use Anonymous Information for the following purposes:

3. HOW WE SHARE PERSONAL INFORMATION WITH OTHERS


We know how important it is to keep your information confidential. We will not share Personal Information with third parties unless specifically approved by you in advance or under the circumstances described below. 


a. Service Providers


We may share Personal Information with companies and individuals that help us promote, provide or support our Website and/or internal operations (“Service Providers”). LSBID has selected Service Providers that maintain high standards with respect to privacy and agree to use the Personal Information only to perform specific services on behalf of LSBID and in accordance with the terms and conditions of this Privacy Policy.


b. Aggregated Anonymous Information


Aggregated Anonymous Information is the combination of your Anonymous Information with the Anonymous Information of other users (“Aggregated Anonymous Information”). Aggregated Anonymous Information does not allow you to be identified or contacted. We may share such Aggregated Anonymous Information with third parties, and, depending on the circumstances, we may charge third parties for such information, or limit the third parties' use of the same. 


c. Compliance with Laws, Law Enforcement and Safety


We may disclose information we have collected about you if required to do so by law or if we, in our sole discretion, believe that disclosure is reasonable to comply with the law, requests or orders from law enforcement, or any legal process (whether or not such disclosure is required by applicable law), or to protect or defend LSBID’s, or a third party's, rights or property. We may also reserve the right to disclose information we've collected about you for purposes of protecting the health and safety of others.

4. THIRD PARTY MATERIALS

As a service to you, our Website may contain advertisements, third party content and links to other third party websites (collectively, “Third Party Materials”).  We do not investigate or monitor Third Party Materials, and therefore are not liable or responsible for the same.  By clicking on an advertisement or other link, you may be redirected from our Website to third party websites.  This Privacy Policy does not apply to such third party websites, and we are not responsible for the privacy policies of such websites.  We encourage you to read the privacy statements of these third party websites as their privacy policies may differ from ours. 


5. OPTING OUT


If at any time you wish to stop receiving correspondence for which you have previously registered, simply follow the unsubscribe directions in our correspondence to you.  In addition, you may request removal of your Personal Information from our database at any time by sending an email to 
info@lincolnsquarebid.org or regular mail to Lincoln Square Business Improvement District, 1841 Broadway, Suite 1112, New York, NY 10023.  Please note that despite any opt-out choices, we may send you administrative messages regarding the Website, including, for example, notices of updates to our Privacy Policy.

Please also note that we may be required to maintain certain Personal Information, or to maintain certain Personal Information for a period of time, in which case we will comply with your deletion request only after we have fulfilled such requirements.  For instance, we may retain your Personal Information for fraud detection or similar purposes.  Be advised that when we delete any Personal Information, it will be deleted from our active database, but may remain in our archives. Note that if we have already disclosed some of your Personal Information to third parties, we cannot access that Personal Information any longer and therefore cannot compel the deletion or modification of any such information by the parties to whom we have made those disclosures.  Even after your Personal Information is deleted, we may maintain Anonymous Information from your Account (which, as a reminder, cannot be used to contact or identify you, and is not linked to information that can be used to do so) to use as part of Aggregated Anonymous Information for legitimate business purposes, including analyzing data metrics and conducting internal operations. 


6. COPPA 


In accordance with the Children’s Online Privacy Protection Act (“COPPA”), we do not knowingly collect or solicit Personal Information from individuals under 13 years of age and no one under age 13 may provide any Personal Information to LSBID. If we later obtain actual knowledge that a user is under 13 years of age, we will take steps to remove that user’s Personal Information from our systems. If you are the parent or guardian of a child whom you believe has disclosed Personal Information to us, please contact us at 
info@lincolnsquarebid.org so that we may delete and remove such information from our systems. 

7. SECURITY AND DATA RETENTION


We are very concerned with safeguarding your information. We employ all reasonable administrative, physical and electronic measures designed to protect your information from unauthorized access. We will make any legally required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored "personal data" (as defined in applicable state statutes on security breach notification) to you via email or conspicuous posting on the Website in the most expedient time possible and without unreasonable delay, insofar as it is consistent with (i) the legitimate needs of law enforcement or (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system. Although guaranteed security does not exist either on or off the Internet, we make commercially reasonable efforts to make the collection and security of such information consistent with this Privacy Policy and all applicable laws and regulations. 

We will retain your Personal Information only for as long as necessary to fulfill the purpose(s) for which it was collected and to comply with applicable laws. Your consent to such purpose remains valid after termination of our relationship with you. 


8. CHANGES TO OUR PRIVACY POLICY 


We reserve the right to change, modify, add or remove portions of this Privacy Policy at any time and without prior notice, and any changes will become effective immediately upon being posted unless we advise you otherwise. However, we will not make any adverse, material changes to the way we use your Personal Information, as described throughout this Privacy Policy, without giving you an opportunity to opt out.  Your continued use of the Website after this Privacy Policy has been amended shall be deemed to be your continued acceptance of the terms and conditions of the Privacy Policy, as amended. We encourage you to bookmark this webpage and review this Privacy Policy regularly.

9. CALIFORNIA PRIVACY RIGHTS

Under California’s “Shine the Light” law, California residents have the right to request in writing from businesses with whom they have an established business relationship: (i) a list of the categories of Personal Information, such as name, address, e-mail address, and the type of services provided to that customer, that a business has disclosed to third parties (including affiliates that are separate legal entities) during the immediately preceding calendar year for the third parties’ direct marketing purposes, and (ii) the names and addresses of all such third parties.
